CK&C has successfully litigated insurance bad faith disputes, including commercial general liability and umbrella policy carriers on behalf of a developer client on a contingent fee basis resulting in a $3.0 million settlement after a Phase I trial, in a case that had been rejected by three other law firms, and a multiparty bad faith case, Smally v. Nationwide Insurance, to a Marin County jury verdict on behalf of a local finance business of more than $1.8 million, including $1.2 million in punitive damages, and a judgment of approximately $2.4 million, that was upheld on appeal. CK&C is frequently called upon to evaluate liability litigation coverage on behalf of its business clients, and has even represented commercial liability carriers in complex contractual and statutory indemnity disputes against other insurance carriers to determine who bears the risk in multi-party construction disputes, where coverage was initially denied.
